Eatsy Terms of Service

Welcome to Eatsy! These Terms of Service ("Terms") constitute a legal agreement between you ("User" or "you") and Eatsy Inc. ("Eatsy," "we," or "us"), governing your access to and use of the Eatsy platform ("Platform" or "Service"). By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please stop using the Service immediately.
1. Service Overview
Eatsy is a web platform for restaurant reservations and food experience sharing. Users can book restaurants, view restaurant information, share personal reviews and photos, and participate in a two-way rating system. Eatsy provides only information and booking functionality and does not assume responsibility for restaurant operations.
2. User Eligibility
You must be at least 18 years old and have full legal capacity to use the platform. If you are under 18, you must obtain consent from a parent or legal guardian and use the Platform under their supervision. You agree to comply with all applicable laws and regulations.
3. Account Registration and Security
3.1 Registration Information
You must provide accurate, complete, and truthful personal information when registering an account, including your name, contact information, and a valid email address. You agree to update your information promptly if there are any changes.
3.2 Account Security
You are responsible for safeguarding your account credentials and must not disclose them to others. Eatsy is not responsible for any loss or damage resulting from unauthorized account use. If you notice suspicious activity, please notify us immediately.
4. User Conduct
4.1 Lawful Behavior
You agree to use the Platform in compliance with applicable laws and these Terms, and not to:
- Post or share false or misleading information;
- Post defamatory, discriminatory, threatening, or otherwise inappropriate content;
- Post violent, obscene, hateful, or offensive materials;
- Upload viruses or malicious code;
- Promote or engage in unauthorized advertising;
- Collect or store other users' personal data without consent;
- Interfere with the normal functioning of the Platform.
4.2 Responsibility
You are solely responsible for your actions and the content you post. You agree to bear any legal consequences resulting from your actions. Eatsy reserves the right to take actions against violations, including restricting functionality, suspending, or terminating accounts.
5. User-Generated Content
5.1 Content Submission
You may submit reviews, images, and other content related to food experiences. You warrant that the content is owned by you or you have legal rights to post it.
5.2 License Grant
By submitting content, you grant Eatsy a royalty-free, worldwide, perpetual, non-exclusive license to use, display, distribute, adapt, and promote the content to support platform operations. This license remains valid even after you delete the content or account. You agree that no additional compensation is required.
5.3 Content Management
Eatsy reserves the right to edit, hide, or delete content that violates these Terms without notice and may take further action against offending users.
6. Platform Usage Restrictions
6.1 Prohibited Actions
You may not reverse-engineer, hack, decompile, or extract any platform code or data. Unauthorized access or tampering is a breach of these Terms.
6.2 Service Limitations
Eatsy may update, modify, or discontinue any part of the Platform at any time without prior notice. We are not liable for service interruptions due to maintenance, updates, or other reasons.
7. Data Protection and Privacy
7.1 Data Collection
Eatsy collects user data, booking history, and behavioral data to improve services, in accordance with our Privacy Policy and applicable data protection laws.
7.2 Privacy Rights
We are committed to protecting your personal data and will only share it within the limits of the law or with your consent. Please refer to our Privacy Policy for full details.
8. Limitation of Liability
8.1 Third-Party Services
Eatsy is not responsible for the products, services, or operations of restaurants. Any issues must be resolved directly with the restaurant.
8.2 Disclaimer
Eatsy provides services "as is" and makes no warranties regarding availability, accuracy, or fitness for a particular purpose. We are not liable for losses caused by technical issues or force majeure.
8.3 Indirect Damages
Eatsy shall not be liable for any indirect, special, incidental, or punitive damages arising from platform use.
9. Technical Support and Downtime
Eatsy aims to maintain uninterrupted service but cannot guarantee it. We are not responsible for losses due to downtime or technical issues.
10. Service Changes and Terms Updates
Eatsy reserves the right to modify or discontinue services and to update these Terms. We will notify users in advance of major changes. Continued use after updates indicates acceptance. If you disagree, please stop using the Service.
11. Termination of Service
11.1 User Termination
You may terminate your account at any time by contacting our support team. We will verify your identity and process the request.
11.2 Platform Termination Rights
We may suspend or terminate accounts without notice in the following situations:
- Breach of these Terms;
- Harmful behavior toward the platform or other users;
- Illegal activity;
- Platform security or compliance requirements.
11.3 Post-Termination Obligations
Upon termination, you lose access to the Platform. We are not obligated to retain your data and may delete it within 30 days, unless legally required to retain it.
11.4 No Liability
Eatsy is not liable for any losses or inconvenience resulting from account termination or service restrictions.
12. Governing Law and Dispute Resolution
12.1 Applicable Law
These Terms are governed by the laws of the Republic of China (Taiwan).
12.2 Amicable Resolution
In case of disputes, both parties agree to resolve them through good faith negotiations. During negotiations, both parties shall fulfill their obligations under the non-disputed portions of these Terms.
12.3 Jurisdiction
If no agreement is reached within 30 days, disputes shall be submitted to the Taipei District Court in Taiwan for exclusive jurisdiction.
